Our terms and conditions

These terms and conditions of sale are applicable to all sales, made (i) by phone or (ii) at the English Eccentrics Studios or (iii) online via the United Kingdom section of the English Eccentric website, Englisheccentrics.com (the "Website"):

Any sale of English Eccentrics Items however made is subject to these terms and conditions of sale. On the internet, by clicking the button marked "I accept the Terms and Conditions of Sale" before confirming his/her order, the customer confirms that he/she has unconditionally accepted these terms and conditions.
These terms may be changed and updated from time to time. The terms applicable to an order by a customer are those in force on the day of ordering.
Please read these terms and conditions carefully before ordering and print a copy for future reference.

Your Order

All orders are subject to acceptance and availability.

All orders, sales and other transactions and are in accordance with English Law, and are carried out in English and under English jurisdiction. Only those who accept these terms and are legally able to enter such contracts should make purchases from English Eccentrics. By making such purchases, the purchaser declares that they are legally able to comply and that all information that they have given, including but not limited to, name, e mail address, postal address, and credit card details, in order to secure the purchase is correct.
By placing an order, you authorise English Eccentrics to perform credit checks either directly or through third parties in order to secure pre-authorisation, authorisation and payment.
Once you have made your choice and your order has been placed, you will receive an email acknowledging the details of your order. This email is NOT an acceptance of your order.
The sale is concluded in London, England once the goods have been despatched. The language of the contract is English. The currency of the transaction is in pounds sterling.
English Eccentrics reserves the right not to accept your order without giving any reason and at our sole discretion
Payment can be made by Visa, Visa Electron, Master Card, American Express, Delta, and Switch debit cards. Payment will be debited and cleared from your account upon receipt of your order by SECPay. You confirm that the credit/debit card that is being used is yours. All credit/debit card holders are subject to validation checks and authorisation by the card issuer.
If the issuer of your payment card refuses to authorise payment to English Eccentrics, we will not be liable for any delay or non-delivery. We will endeavour to inform you of any difficulties in securing payment with your chosen card.

Pre -Orders

We may offer a reservation, priority or pre-order service on selected items that may not available at the time of the order or are not available at all of our sales points. Such orders will not be processed until we have received full payment of your order.

Deposit

We may offer certain products for sale which are made to order. For these items, we will seek a deposit of 30% - 50% depending on the nature of the product, which will be non refundable in the event of the customer changing their mind.

Prices

All prices are in Pounds sterling GBP including VAT but exclude delivery charges
Whilst we try to ensure the prices are accurate, errors may occur. Should we find an error in the price of an article you have ordered, we will give you the option of reconfirming your order at the correct price or cancel it. In the case we can not contact you; the order will be treated as cancelled.

Delivery

Delivery will be Royal Mail, Parcel Force or an organisation of similar capability.
Delivery will be sent as soon as possible after your order is received and payment confirmed. This will usually be within 48 hours (excluding weekends). This should give a next day after despatch delivery.

Items can only be delivered to:
• the customer's permanent residence;
• a delivery address specified by the customer, being the permanent residence of a third party of his/her choice or,
• the customer's place of work, if located in the United Kingdom;
• in no circumstances can delivery be made to a hotel or post office box.
• the customer undertakes to supply the exact address of his/her permanent residence when placing the order.
• delivery shall take place after confirmation of payment for the order is received. While every endeavour will be made to meet the delivery times offered at the time of sale, the delivery shall take place no later than:
-either within 30 days of the date of ordering;
-or, in the event of the item's temporary unavailability accepted by the customer, by the deadline(s) specified to the customer

Risk and Title

Risk in the Items will pass at the time of delivery.
Ownership of the items delivered will only pass to the customer when full payment of all sums due in respect of the item(s), including packing and delivery costs is received by the Company. In the event of incomplete or partial payment, the Company may, without prior notice, claim any item(s) delivered by the Company to the customer.

Proof of order

The Company and the customer e-mails and any automatic saving systems used on the Website and by the Customer Relations Department shall count as proof of the agreement between the parties, in particular as regards the nature and date of the order.
The Company shall retain the information concerning all orders for at least 3 years. The information held can be made available to the customer. The customer is advised also to keep a copy (electronic or printed) of the information concerning his/her online order

Returns

Please do not return anything to us until you have contacted us and received a Returns Authorisation Number, RAN. To receive your RAN, please contact us at Customer Services at English Ecentrics or on +44 (0)20 7284 2525

Please check all garments thoroughly upon delivery before removing any attached tags and before disposing of any original packaging. . Please return all goods unused, in perfect condition and in the original packaging. Please retain the original packaging for this purpose.

Goods will only be refunded after a quality control check has verified that the goods in question qualify for a return

We will then give you options on how to return your goods. This applies whether you are returning the goods because they are faulty or for any other reason.
Fashion goods are time sensitive so, please return goods within 7 days of receiving your return options. Late returns can only be accepted at the sole discretion of English Eccentrics

Where a ‘do not remove tag' has been affixed to items of clothing, this must remain in place for a refund

Customers are responsible for the costs of carriage unless the goods are found to be faulty.

Please note that we do not accept liability for returned goods if you do not return them to according to our return options policy.

Please note that international customs duties and sales taxes are NOT refunded for shipments outside the European Community (EU).

Return or Exchange

Articles are accepted for refund, credit or exchange if notified to English Eccentrics within 7 days and are in saleable condition, accompanied by a sales receipt.

Where a ‘do not remove tag' has been affixed to items of clothing, this must remain in place for a refund or exchange

A refund will be made to the purchaser upon request if payment has been received. Gift recipients are entitled to a non-refundable merchandise credit. To return or exchange your gift selection, please follow the instructions included in the options to return e mail.

Before returning any items to us, please would you be kind enough to contact us at Customer Services at English Ecentrics or telephone +44 20 7284 2525 for your RAN.

Please return all goods in one shipment in order to keep down carriage costs
If you wish to exchange, please email us your required size and we will reserve it for you if the item is in stock.

Faulty Goods

Please do not return anything to us until you have heard from us.
Faulty items will only be accepted if the goods are delivered to the customer damaged or there is a subsequent manufacturing fault within a period of 6 months after delivery. All items returned as faulty will be inspected and any items deemed to subject to fair wear and tear will not be accepted as faulty.
Exchanges are possible if the item is available. We can only exchange faulty items for the same item in the same size, subject to availability. If you wish to exchange, please make your request clear when contacting us
Where possible items may be repaired on request but only where such items are deemed faulty and repairable. Repairs do not come with any guarantees.

Receiving a Refund

Refunds to you will be made as soon as possible but, in any event, no later than 30 days of the date of receipt of the returned goods. All undamaged, correctly returned products will be credited to the original purchaser's credit card including sales taxes for all EU country shipments excluding shipping charges.
International customs duties and sales taxes are non- refundable for shipments outside the European Community (EU).

Gift returns

If you have received an item from English Eccentrics as a gift you can return it in exchange for a store credit to your account (If you are not already registered , then you will be asked to register.) You will then be able to exchange your unwanted gift an online credit. Please note that you will be asked to pay any difference in cost and any additional shipping, taxes and import duties. Any unused credit can remain on your account until your next purchase. We are unable to refund any amounts except to the original purchaser.

Conformity – Warranty

Your Statutory Rights are not affected

If any delivered item does not correspond to the order, then in addition to the customer’s statutory rights, the Company agrees to replace the item or, if this is not possible, refund the customer as set out below.
The customer must check that the items delivered correspond to the order. If any delivered items do not match the order, the customer shall inform the Company as soon as possible, either by e mail to customerservices@englsisheccentrics.com or by telephone to 020 7284 2525 specifying which item does not match the order, and return the relevant item(s) in its/their original packaging, in the condition in which it was delivered to him/her, complete (with accessories, notice, warranty document, etc.) and with a copy of the bill and the Return/Replacement Form to the address given with the delivery.
Items must be returned by registered post or another secure method with a guaranteed delivery date. Return delivery costs will be borne by the Company if the non-conformity of an item is confirmed by the Company/and upon receiving proof from the customer of the delivery costs incurred.
If replacement of the non-conforming item is impossible, or if the customer does not wish to receive a credit note from the Company, a full refund of the billed price (cost of item and packing and delivery costs) of the non-conforming items will be made by crediting the customer's bank account or credit card/debit card upon receipt by the Company of the returned items.
Cancellation
English Eccentrics reserves the absolute to refuse or cancel any order at its absolute discretion

Customer Right of Cancellation

The customer has the right to cancel the contract without need for justification, up to seven (7) days (excluding Saturdays, Sundays and public bank holidays) after the date of receipt of the said item by the customer.
To exercise his/her right of cancellation before the Items have been delivered, the customer must give written notice to the Company or by telephone to tel. no.: 020 7284 2525 or by email to Customer Services at English Ecentrics , giving details of the Items ordered, the order number and (where appropriate) the delivery date.

To exercise his/her right of cancellation after the Items have been delivered, the customer must return the delivered item within the stated period, in its original packaging, in the same condition in which it was delivered to him/her, complete with a copy of the invoice and the Return/Replacement Form attached to his/her order, to the address indicated on the form.

The customer is recommended to send the items by the shipper nominated by English Eccentrics. registered mail or other method with a guaranteed date and should keep a proof of return. The costs of returning the Items will be borne by the customer.
If the customer does not return the Items as required under these terms and conditions, the Company will charge the customer a sum not exceeding the direct cost of recovering those items.
Reimbursement of the billed price of returned items (including packing and delivery costs) will be made by crediting the customer's bank account or credit card/debit card as soon as possible and in any case within a period not exceeding thirty days from the notification by the customer of the cancellation of the contract. Items that are returned incomplete, spoilt, damaged, deteriorated or dirty will not be reimbursed.
When the Items are delivered to a third party chosen by the customer, the right to cancel the Contract under this clause can only be exercised by the customer and cannot in any circumstances be exercised by the third party.

Payment

Payment for goods ordered on the internet shall be by Credit or Debit Card online.
For goods ordered by telephone, then payment maybe made by credit, debit card or cheque, supported by a bankers card or, in person, with any of the above or in cash

The customer's credit card/debit card is debited within six days of (i) the communication of his/her credit card/debit card number and/or bank details to the Company; (ii) clicking on the CONFIRM YOUR ORDER button on the Website, at the end of the order after the Company has checked: that the customer order complies with these terms and conditions; the item availability – even in the event of temporary unavailability accepted by the customer - and before shipment by the Company.
Should it be impossible to debit the amounts owed by the customer for any reason whatsoever (refusal by the bank, etc.), the order shall be deemed cancelled.

Online payment by credit card/debit card is protected by SSL. All the Website pages under https are of a secured server operating in SSL mode (128 bits), to ensure the customer’s payment is securely processed. The customer enters his/her credit card/debit card number and/or bank details via an online payment order form. The transaction is then made through banking security encrypted standards. In transmitting his/her bank details, the customer accepts in advance and unconditionally that the Company will perform the secure transaction. The customer therefore authorizes in advance his/her bank to debit his/her credit card/debit card or bank account in view of the records or statements transmitted by the Company, even in the absence of bills signed by the cardholder. The customer account debit authorisation is always given for the amount of the item(s) purchased as billed by the Company.
The Comapny shall not be held responsible for the outcome and consequences whatsoever of unauthorised access and/or intrusion by a third party to the said server (e.g. hacking). In order to avoid any risk of hacking, the Company does not record the customer’s credit card/debit card number and/or bank details which are entered by the customer in the online payment order form.
Delivery shall only be made in the United Kingdom.

Security

We take all reasonable care to make our Site as secure as we can make it. All credit card transactions on this site are processed using XXXXXX, a secure online payment gateway that encrypts your card details in a secure host environment. English Eccentrics does not hold your credit card details on the website or on a customer database.
To help ensure that your shopping experience is safe, simple and secure English Eccentrics uses Secure Socket Layer (SSL) technology. This encrypts and protects the data you send to us over the internet. If SSL is enabled then you will see a padlock at the bottom of your browser and you can click on this to find out information about the SSL digital certificate registration.
Furthermore, we will take all reasonable care, in so far as it is in our power to do so, to keep the details of your order and payment secure, but in the absence of negligence on our part we cannot be held liable for any loss you may suffer if a third party procures unauthorised access to any data you provide when accessing or ordering from the Site.

Insurance

English Eccentrics insures each purchase during the time it is in transit until it is delivered to you. You will be asked to sign for any goods delivered at which point responsibility for your purchased goods passes to you.

Intellectual property rights

The customer is granted a license for use of the Website, which remains the exclusive property of the Company, which has created and published online the web pages, images and source scripts and data. Consequently, the customer shall not broadcast or copy the Website, in whole or in part, in any form whatsoever.
English Eccentrics items and trademarks, as well as all other marks, illustrations, images, designs and models and logos figuring on the Company's items sold, their accessories or packaging, whether registered or not, are and remain the exclusive property of the Company. Full or partial reproduction, downloading, alteration or use of these brands, illustrations, images and logos, designs and models, for any reason and on any medium whatsoever, without the Company's express prior written authorisation is strictly prohibited.

Limited use is granted for students and others for use in personal study; or journalists for publication in journals, articles and the like so long as they are part of the editorial copy and not treated for for commercial gain.

Use of all or part of the site, in particular by means of downloading, reproduction, transmission, representation or circulation for purposes other than personal and private use with a non-commercial aim by the internet user, is strictly prohibited.

Taxes

Prices on the web site are shown as UK VAT inclusive.
During the check out procedure, the customer will identify which country is the destination for the merchandise, this information is used to then calculate the Customs duties and Sales taxes of the country specified by the customer. The Customs Duties and Sales taxes are calculated and shown to the customer as part of the final invoice before the customer authorizes payment.
Value Added Tax is charged on all goods at 17.5%
All Local Taxes, Taxes and import duties are payable by the customer

Trademarks and Copyright

All trademarks and copyright in all words, images, designs and logos are the property of English Eccentrics (Eccentric Clothes Limited) unless otherwise stated.

Limit of Liability

While being as careful and as accurate as possible regarding their online publishing, the items' descriptions and the data available their updating, the Company cannot be held responsible for any insubstantial errors that may occur.

The Company will not be liable to the customer by way of representation (unless fraudulent), common law duty or under any express or implied term of the Contract for:

  • any losses which are not reasonably foreseeable by both Parties when the Contract is formed arising in connection with the supply of English Eccentrics Item(s) and related services or their use by the customer;
  • any losses which are not caused by any breach by the Company;
  • business or trade losses.

The Company's entire liability in connection with the Contract will not exceed the purchase price of the English Eccentrics Item(s) in question.
Nothing in this Contract means that the Company's liability to the customer for death or personal injury resulting from the Company's negligence or that of its employees, agents or sub-contractors is limited.

Acceptance

Your continued use of our site will signify your acceptance of these Terms and Conditions and of any subsequent changes or amendments.
Force Majeure - Events beyond the Company's reasonable control

The Company will not be responsible for any failure to perform or, delay in performance of, any of its obligations under a contract that is caused by events outside its reasonable control (Force Majeure Event).
In this context, Force Majeure Events include (without limitation) war, riots, insurrection, social unrest, computer or telephone failures, severe disturbance in the security and coherence of the Internet, technical failures, unauthorised access and/or intrusions into the Website's secure and encrypted servers, strikes of all natures and Company procurement problems.
The Company shall inform the customer of such a Force Majeure Event within seven days of its occurrence. If the Force Majeure Event continues beyond fifteen days, the customer may cancel the order in progress, which will be reimbursed by the Company as rapidly as possible by crediting the customer's credit card/debit card or bank account.

Non-waiver

The failure by the Company to enforce one or more of the provisions of these terms and conditions of sale does not constitute a waiver of such rights or remedies and shall not relieve the customer from compliance with such obligations.

Validity of these terms and conditions of sale

If any of the provisions in these terms and conditions of sale is declared wholly or partly invalid, unlawful or unenforceable, the other provisions and other rights and obligations resulting from these terms and conditions will remain valid to the fullest extent permitted by law.

Applicable law

These terms and conditions are governed by the laws of England and Wales.
Any dispute arising from, or related to, these terms and conditions shall be subject to the non-exclusive jurisdiction of the English courts.
